Terms of Service

By accessing or using TradingSFX (the "Service"), operated by TradingSFX ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

TradingSFX is a trading journal and performance analytics platform that provides tools for trade logging, confluence tracking, performance analytics, and AI-powered coaching insights. The Service is available through web and mobile interfaces and may include both free and paid subscription tiers.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service. We reserve the right to suspend or terminate accounts that violate these Terms.

Paid Plans

TradingSFX offers subscription plans with different features and pricing. Details of each plan are available on our pricing page. Prices are subject to change with reasonable notice.

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be issued for partial billing periods unless required by applicable law.

Free Tiers & Promotions

We may offer free tiers, trial periods, or promotional offers at our discretion. These offers may be subject to additional terms and may be modified or discontinued at any time.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Use automated tools, bots, or scrapers to access the Service without our written consent
• Harass, abuse, or threaten other users
• Resell, redistribute, or sublicense access to the Service without authorization
• Use the Service to manipulate markets, facilitate fraud, or engage in any illegal financial activity

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending accounts, and reporting to law enforcement.

You retain full ownership of any data, trade logs, notes, screenshots, and other content you submit to TradingSFX ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing and improving the Service.

We do not claim ownership of your User Content. We will not sell, share, or use your User Content for purposes unrelated to providing the Service, except as described in our Privacy Policy or with your explicit consent.

TradingSFX provides AI-powered coaching, analytics, and insights as supplementary tools. You acknowledge and agree that:

• AI-generated content is for informational and educational purposes only
• AI insights do not constitute financial advice, investment advice, or trading recommendations
• AI outputs may contain errors, inaccuracies, or incomplete information
• You are solely responsible for your trading decisions and should not rely exclusively on AI-generated insights
• Past performance analytics do not guarantee future results

TradingSFX is a journaling and analytics tool. Nothing on the platform constitutes financial advice, investment advice, trading advice, or any other form of professional advice. We are not a registered broker, financial advisor, or investment advisor. All trading involves substantial risk of loss, and you should consult with a qualified financial professional before making any investment decisions. You are solely responsible for your own trading and investment decisions.

The Service, including its design, code, branding, logos, text, graphics, and software, is owned by TradingSFX and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, except as permitted by law.

To the maximum extent permitted by law, TradingSFX and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, trading losses, or other intangible losses, arising from:

• Your use of or inability to use the Service
• Any trading decisions made based on information provided by the Service
• Unauthorized access to or alteration of your data
• Any interruption or cessation of the Service
• Any errors, inaccuracies, or omissions in AI-generated content

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

You agree to indemnify, defend, and hold harmless TradingSFX and its founders, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data before or within 30 days of termination by contacting us. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
